Propose4u – Luxury Marriage Proposal Planning Worldwide
1. OPERATOR AND ACCEPTANCE
Propose4u.com is operated by Inbal Roimi, Israel (“Propose4u”, “we”, “us” or “our”). These Terms govern the use of the Propose4u website and set out the general framework for our marriage proposal planning, design and coordination services. Use of the website signifies acceptance of the terms relating to browsing and website use. A booking for our services is formed only as described below. Mandatory consumer rights and laws that cannot lawfully be excluded take priority over any inconsistent provision in these Terms. If you do not accept these Terms, please do not use the website.
2. NATURE OF THE WEBSITE AND OUR SERVICES
Propose4u.com is an information and enquiry website offering marriage proposal planning and coordination services in international destinations and Israel. The website displays destinations, proposal concepts, photographs, videos, examples and potential packages. Website content does not constitute a binding offer, guarantee availability or guarantee that a future marriage proposal will be identical to a previous proposal, photograph or video. The website does not currently provide automated checkout or direct online booking. The final package, price, date, location and included elements are confirmed individually with the client in writing. Flowers, colours, decorations, props, layouts, views, locations and other elements may vary depending on availability, local conditions, regulations, weather and circumstances at the destination.
3. INFORMATION PROVIDED BY THE CLIENT
The client must be legally capable of entering into an agreement. The client agrees to provide accurate and current information reasonably required to plan the marriage proposal, including contact details, destination, dates and any relevant accessibility or safety requirements. The client must inform us promptly if any relevant information changes.
4. QUOTATIONS, BOOKING AND DATE RESERVATION
An enquiry submitted through the website, email, telephone, Instagram, Facebook or WhatsApp does not constitute a confirmed booking. Propose4u will provide the client with the details of the proposed package and its total price. The package may include design, decorations, coordination and other elements or services described to the client. Where independent local suppliers are involved, payment of the total package price may be divided between Propose4u and one or more local suppliers. Before confirming the booking, the client will be informed of:
- the total package price;
- the amount payable to Propose4u to confirm the booking;
- the remaining amount, where applicable, payable directly to the relevant local supplier; and
- the principal elements included in the package.
A booking is confirmed only after the client has accepted the booking details and Propose4u has received the amount required to confirm the booking. Payment of the amount requested by Propose4u confirms the client’s acceptance of the booking details and applicable booking conditions communicated to the client. Specific written terms provided for an individual booking take priority over these general Terms where they differ, except where mandatory legal or consumer rights apply.
5. PRICES AND PAYMENT
The price communicated to the client is the total price of the marriage proposal package and the elements expressly included in that package. For proposals involving independent local suppliers, payment of the total package price may be divided between Propose4u and the relevant supplier or suppliers. The client will be informed before booking of:
- the total package price;
- the amount payable directly to Propose4u; and
- the remaining amount payable directly to the relevant independent local supplier or suppliers.
An amount paid directly to an independent supplier forms part of the total package price communicated to the client but is paid directly to that supplier and is not received, held or processed by Propose4u. Unless expressly stated otherwise, services, upgrades or additions requested by the client beyond the agreed package may result in an additional charge, which will be communicated before confirmation. No additional amount payable to Propose4u will be charged without the client’s approval. Bank charges, currency conversion costs and international transfer fees are the client’s responsibility unless otherwise agreed in writing.
6. CANCELLATION, POSTPONEMENT AND CLIENT CHANGES
Cancellation, postponement or change requests must be communicated in writing to info@propose4u.com or through the WhatsApp conversation used for the booking. The request takes effect when it is received by us. Any mandatory statutory cancellation or cooling-off rights applicable to the booking remain unaffected. Cancellation and rescheduling conditions applicable to the individual marriage proposal will be communicated to the client before the booking is confirmed. Amounts already paid to independent local suppliers are subject to the applicable supplier’s cancellation and refund conditions where legally applicable. Any amount paid directly to a supplier is held by that supplier and not by Propose4u. After any applicable statutory cancellation period has expired, any refund of an amount paid to Propose4u will be determined according to the agreed booking conditions, taking into account planning and coordination work already performed and commitments reasonably made in connection with the booking. Where possible, Propose4u will work with the client and relevant suppliers to explore reasonable alternatives such as a change of time, location or date.
7. WEATHER, SAFETY, LOCATIONS AND EVENTS BEYOND OUR CONTROL
Many marriage proposals take place outdoors or in public or semi-public locations. They may be affected by wind, rain, waves, extreme weather, crowds, maintenance work, access restrictions, local events, instructions from authorities or other circumstances outside our reasonable control. Absolute privacy cannot be guaranteed in a public location. Where circumstances create a safety, legal or significant practical concern, Propose4u and/or the relevant local supplier may propose:
- an adjustment to the design;
- a different time;
- an alternative location; or
- postponement where reasonably possible.
Neither party will be considered in breach solely because of a delay or failure caused by circumstances outside its reasonable control, including severe weather, government action, security incidents, closure of a location, transport disruption, strikes or natural disasters. Any non-recoverable payments made directly to independent suppliers remain subject to the relevant supplier’s terms and applicable law.
8. PHOTOGRAPHY, VIDEO AND DRONES
Photography and videography may form part of a marriage proposal package where expressly included in the booking details. Outside Israel, photography, videography and drone services are provided by independent local photographers, videographers or drone operators where applicable. Where payment for these services is made directly to the relevant supplier, that payment forms part of the total package price where stated as such but is received directly by the supplier. Independent photographers, videographers and drone operators are responsible for their professional work, equipment and compliance with applicable local laws, permits, aviation regulations and safety requirements. Photography, videography and particularly drone operation may be affected by weather, lighting, local restrictions, permissions, safety considerations and technical conditions. Neither Propose4u nor an independent photographer or videographer can guarantee that every moment or a particular photograph, video or camera angle will be captured. Where Propose4u itself expressly provides complimentary drone footage in Israel, such footage is an ancillary complimentary benefit to the main marriage proposal service. Complimentary drone footage is subject to weather, safety, technical conditions, aviation regulations, location restrictions and the judgement of the operator. If complimentary drone footage cannot safely or lawfully be captured, this will not by itself constitute non-delivery of the main marriage proposal service or create an entitlement to a price reduction, except where otherwise required by applicable law.
9. MARKETING USE OF PHOTOGRAPHS AND VIDEO
Photographs and videos from a client’s marriage proposal will only be used by Propose4u for marketing or promotional purposes where the client has provided express permission. Permission may be provided in writing through WhatsApp or another recorded communication method. Where permission is provided, Propose4u may use the approved photographs and/or videos on:
- propose4u.com
- Propose4u’s Instagram
- Propose4u’s Facebook channels
Permission for marketing use is optional. The client may withdraw permission at any time by contacting Propose4u. Following such a request, we will stop future use and remove the relevant media from channels under our control within a reasonable period. We cannot guarantee removal of copies that have already been independently shared, downloaded or republished by third parties outside our control.
10. INDEPENDENT LOCAL SUPPLIERS
Propose4u works with and coordinates independent local suppliers in the destinations where marriage proposals take place. These may include:
- designers and decorators;
- florists;
- photographers and videographers;
- musicians;
- drivers;
- venues and restaurants;
- boat operators; and
- other local service providers.
Unless expressly stated otherwise in writing, these suppliers are independent businesses or professionals and are not employees of Propose4u. Propose4u may select, recommend, introduce and coordinate local suppliers as part of the marriage proposal package. Where applicable, the client pays the portion of the total package price allocated to a local supplier directly to that supplier. Payment made directly to the supplier is received and held by the supplier and not by Propose4u. Independent suppliers remain responsible for the professional performance of the services they provide and for compliance with laws, licences, permits and professional requirements applicable to their activities. Propose4u may assist with communication and coordination between the client and suppliers as part of our service. We share with suppliers only information reasonably required to coordinate the client’s marriage proposal. Unless expressly confirmed otherwise in writing, Propose4u does not sell flights, accommodation, travel insurance, visas or immigration services and does not act as a travel agent for those services. The client remains responsible for passports, visas, travel insurance, flights, accommodation, transportation and other personal travel arrangements.
11. CLIENT RESPONSIBILITIES
The client agrees to:
- arrive at the agreed time and follow reasonable instructions relating to the proposal plan;
- follow the agreed route, timing and cover story where relevant;
- disclose relevant accessibility requirements, allergies, medical limitations, animal fears or other safety information in advance;
- follow reasonable safety instructions provided by Propose4u, the location or participating suppliers;
- take responsibility for passports, jewellery, the engagement ring and other personal valuables; and
- provide accurate information required for planning and coordination.
The client is responsible for ensuring that their travel arrangements allow sufficient time to attend the marriage proposal as planned.
12. INTELLECTUAL PROPERTY
The Propose4u website, brand, logo, text, graphics and original website content belong to Propose4u or the relevant licensed rights holders and may not be copied, republished or commercially exploited without permission except where permitted by law. Photographs and videos created by independent photographers or videographers may remain subject to the intellectual property rights and terms of the relevant creator. The client’s permitted use of photographs or videos delivered by an independent supplier will therefore be subject to the arrangement with that supplier. Nothing in these Terms transfers copyright belonging to an independent photographer, videographer or other creator unless expressly agreed by the relevant rights holder.
13. ACCEPTABLE WEBSITE USE AND EXTERNAL SERVICES
You must not misuse the Propose4u website, attempt unauthorised access, introduce malicious software, unlawfully collect information, impersonate another person or interfere with the operation or security of the website. The website may contain links to or integrations with external services including WhatsApp, Instagram, Facebook, YouTube and Google. Those services operate under their own terms and privacy policies.
14. LIABILITY
Propose4u is responsible for the planning, coordination and other services that we expressly agree to provide directly to the client, subject to applicable law. Independent local suppliers are responsible for the professional services they provide, including their own acts, equipment, personnel, licences, permits and compliance with applicable local requirements. Propose4u will use reasonable care in selecting, recommending and coordinating independent suppliers. Where an independent supplier receives payment directly from the client for its portion of the package, Propose4u does not receive or hold that supplier’s payment. To the extent permitted by applicable law, Propose4u will not be responsible for loss arising solely from the acts, omissions, delays, cancellations, technical failures or professional performance of an independent supplier where the matter is outside Propose4u’s reasonable control. This does not remove responsibility that Propose4u has under applicable law for its own acts, negligence, representations or contractual obligations. To the extent permitted by applicable law, Propose4u is not liable for indirect or consequential loss, loss of profit or opportunity, reliance on general website information or loss caused by materially inaccurate or incomplete information supplied by the client. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer remedies.
15. PRIVACY
Our Privacy Policy explains how Propose4u collects, uses, shares and protects personal information. Please read the Privacy Policy before submitting personal information through the website, email, telephone, Instagram, Facebook or WhatsApp. Where permission for the marketing use of photographs or videos is provided, such permission is handled as described in these Terms and our Privacy Policy.
16. CHANGES, GOVERNING LAW AND DISPUTES
We may update these website Terms from time to time. Changes to these Terms will not retrospectively alter an existing confirmed booking where doing so would conflict with the booking agreement or applicable law. These Terms are governed by Israeli law. Israeli courts have jurisdiction, subject to any mandatory consumer rights or applicable laws that give a client the right to bring proceedings elsewhere.
